HC to hear PIL to remove "illegal" party offices in Mumbai

MUMBAI: Bombay High Court today is slated to hear a public interest litigation challenging encroachments near Nehru Garden at Nariman Point by offices of political parties.

A division bench of Justice Vasanti Naik and Justice CV Bhadang will hear petitions by three residents association urging removal of political parties like BJP and Janata Dal and State bodies like Maharashtra Tourism Development Corporation, Employment Exchange and Zunkha Bhakar Kendra. On August 20, 2013 HC restrained BJP from carrying out further renovation of its office and directed a status quo in all respects in he garden.

At a previous hearing last year, the advocate for the residents had told court that despite the stay construction was carried out. BJP's advocate submitted that the structure was part of the barracks built in 1914 and hence exempted since they existed before the development control regulation and development plan (DP) coming into force. BJP was allotted the place by the government in 1978. State's advocate also told the court that structures prior to DP of 1991 are allowed to continue.
