HC sets aside MLC’s election

MUMBAI: The Bombay HC on Tuesday set aside the election of member of legislative council (MLC) Jayawantrao Jadhav of the NCP. Justice Rajesh Ketkar declared Shiv Sena's Shivaji Shahane as the MLC elected from the Nashik Local Authorities Members' Constituency. The elections were held in 2012. "Shahane is declared to have been duly elected," the judge said on plea by the Sena candidate.

"The returning Officer committed serious illegality in rejecting (the four first preference votes cast in favour of Shahane). If these votes are added to the votes secured by Shahane, it has to be held that he secured 225 votes as against 221 votes secured by the Jadhav. The returning officer ought to have elected Shahane instead of having recourse to drawing of lots," said Justice Ketkar. The HC has stayed its order for 8 weeks to allow Jadhav to file an appeal, but restrained him from spending funds allocated to him.—Shibu Thomas
