Bombay high court to hear review petition on JJ flyover

MUMBAI: Bombay High Court is slated to hear on Monday a review petition by a Mumbai based advocate challenging the fine imposed on him for riding a two-wheeler on the 2.4km long JJ Flyover.

A division bench of Chief Justice Mohit Shah and Justice M S Sonak will heard a petition by advocate Asif Siddiqui for reviewing the HC's July 17 order dismissing his petition. On June 9 he was restrained from riding his bike around 10.30 am and his license seized. The HC's order had noted that two public interest litigation on the same subject was dismissed in 2010 and the ban was upheld.

At the August 25, 2014 hearing, the governemnt's advocate Milind More informed the court that after the ban, from 2010 to 2014, there were 29 deaths and 24 cases of injuries. "These have happened at night because police constables are there till 11 pm," he said. More said since the flyover is "curvy and not a straight bridge there are fatal accidents and the injured are likely to fall off it."

Siddiqui argued that he is concerned about the charges levied against him for entering a "no entry zone". He said the court instead had proceeded on the footing that earlier two PILs are dismissed on the ground that the issues raised in them cannot be a matter of judicial review. The judges then directed More to file an affidavit giving these statistics so that they can incorporate it in their order at the next hearing.
