HC to hear PIL on night shelters for the homeless

MUMBAI: Bombay high court will hear today public interest litigation seeking direction to the state government to set up night shelters for the homeless.

A division bench of Chief Justice Mohit Shah and Justice M S Sanklecha will hear a petition filed by NGO Homeless Collective, alleging that state government had made false submissions to Supreme Court on the number and conditions of the shelters in Mumbai. SC in 2010 had mandated setting up of year round night shelters while hearing a petition on urban malnourishment.

At a hearing on November on 29, 2013, the NGO's advocate Abhishek Jebaraj had told the court that no concrete steps have been taken to set up night shelters by the BMC and the state government. "Not a single shelter has been set up. Not only are they are not building shelters but are evicting people arbitrarily off the streets as happened at Charni Road recently," said Jebaraj. He also said it is difficult for the homeless in winter with the effect of cold weather. "It is not as cold as in other places," riposted Justice Shah. "In Mumbai, even people who are ready to pay don't get shelter," he added.

BMC advocate said the civic body is trying to identify places where night shelters can be set up. She also informed that four night shelters will be started by the end of December. Recording her statement, the judges adjourned the hearing beyond Christmas vacation.
