MUMBAI: Bombay high court has rejected an appeal by a screen writer to stay the release of the film Bombay Talkies on the ground that his suit before the city civil court was adjourned to June 28, 2013 sealing his fate. Nishant Ranjan alleged that director Anurag Kashyap has robbed'' his story line.
Justice B R Gavai on May 3, 2013 heard an appeal filed Ranjan seeking ad interim relief. The court was informed that the film has released the same day. Ranjan's advocate argued that in 2011 he had mailed the synopsis to Kashyap but in February 2013 his client learnt that one segment of the film Bombay Talkies, which is directed by Kashyap, has used his storyline. He complained to the Film Writers Association whose dispute settlement committee issued notice to Kashyap who did not comply.He said FWA has no power to issue summons and hence he moved the City Civil Court to restrain the film and for deletion of storyline.
His advocate said Ranjan moved the civil court but sought adjournment to approach the Indian Motion Pictures Producers Association but learnt they adjudicate disputes between producers and not writers and producers. Another director wanted to use the story to make a 3 hours film. The project is spoiled. I was to get a lot of money and fame,'' he argued.Kashyap's counsel Venkatesh Dhond said the storyline is completely different.
But Justice Gavai said it is quite possible that after lower court judge heard both sides and gave an inclination of the fate of the suit on April 26, 2013, Ranjan sought request for adjournment. The conduct of asking an adjournment itself is deplorable, '' said Justice Gavai, adding that the lower court cannot be faulted. Rejecting the appeal, the judge said if Ranjan succeeds in the suit he can always seek damages.
