MUMBAI: The Bombay high court has asked the state to consider an application by Salil Chaturvedi, owner of Provogue, seeking a transfer of the probe in a case filed by him against the police for allegedly planting three vials of cocaine in his house six years ago. Hearing a petition filed by Chaturvedi, a division bench of Justices Abhay Oka and Sadhna Jadhav referred to the July 2012 circular of the state government that puts in place a mechanism to handle applications of transfer of investigations. The court has given the state two weeks time.

According to the circular, every police stations has set aside a day when complaints against probes are heard by a senior police officer. The system also includes complaints being heard by the chief minister.

Chaturvedi was arrested in August 2005 after cops claimed that 3gm cocaine was found at his Lokhandwala bungalow. In 2009, a special NDPS court acquitted Chaturvedi. He then filed a private complaint before the metropolitan magistrate. With no progress in the probe, he approached the HC, which in 2009 had transferred the probe to the CID. Chaturvedi has urged the HC to transfer the probe to an independent agency like the CBI.
